Private to County Road Improvement Process via Special Tax Assessment

#1      Petition for Public Information Meeting                                                       

  • Road Captain(s), typically a resident(s) on the street in question, will work to acquire property owner signatures on a petition and submit to the Roads Division.
  • If a majority of property owners sign, staff will prepare a MEMO to the County Commissioner’s requesting a Public Information Meeting
  • If a majority of signatures are not collected the project will be tabled

#2      Memo to Commissioners- Request for Public Information Meeting

  • If approved by the Commissioner’s, a notification will be mailed to all property owners including:
    • Meeting Time and Location
    • Scope of Project
    • Engineer’s Estimate
    • Financing Terms (5% over 10 years payable quarterly)
    • Assessment Methods with Estimated Payment Schedule
    • Construction Timeline
  • If not approved a notification will be mailed to all property owners and the project will be tabled

#3      Public Information Meeting                                                                                  

  • The project and Special Tax Assessment process as presented in the notification are reviewed in detail
  • There is a Question and Answer period
  • A vote of those in attendance is taken to determine number of property owners for and against the project

#4      Memo to Commissioners- Request for Public Hearing                            

  • If approved by Commissioners a Certified Mail notification will be sent to all property owners including:
    • Meeting Time and Location
    • Scope of Project
    • Engineer’s Estimate
    • Assessment Methods with Estimated Payment Schedule
    • Construction Timeline
  • If not approved a notification will be mailed to all property owners and the project will be tabled

#5      Public Hearing- Chaired by Commissioners and County Attorney

  • The project and Special Tax Assessment process as presented in the Certified Mail notification are reviewed in detail
  • Property owners are allowed to testify if they are For or Against to Project
  • There is no Question and Answer period

#6      Public Record Held Open for 2 Weeks                                                                           

  • During this period staff will accept and log all emails, letters, faxes and telephone conversations/messages as part of the public record

#7      Memo to Commissioners with Statistics of Public Record                  

Staff will present the public record at a regular County Commissioner’s meeting at which time the Commissioners could vote to move forward, or table, the project

#8        NOTIFICATION OF COMMISSIONER’S DECISION                                                        

  • Certified notification is sent to all property owners of the Commissioner’s decision

#9      Project Completion/Assessment Payment                                                   

  • Upon completion of project property owners will be notified of their total assessment with payment schedule
  • At that time property owners may choose from 2 options:
    • Lump sum payment
    • Annual payment (no repayment penalty)
